Iberia Man Convicted of Attempted Second Degree Murder, Aggravated Battery and Second Degree Battery

     New Iberia, Louisiana:  16th District Attorney, Bo Duhe' announced Cody Toucheck (D.O.B. 4-14-1991) was sentenced to a total of thirty-six (36) years in prison for attempted second degree murder, aggravated battery and second degree battery.

     Toucheck committed a second degree battery on May 31, 2016, by beating and kicking his girlfriend requiring her to have emergency surgery to remove her spleen.  On June 16, 2016, a warrant for his arrest was issued.

     On June 2, 2017, an additional warrant was issued for Toucheck for attempted second degree murder and second degree battery that occurred on January 1, 2017.

     The attempted second degree murder resulted from Toucheck attacking another girlfriend as she returned to her residence.  When the victim approached the front door, Toucheck struck her in the face and began beating and stabbing her causing multiple wounds to the victim's neck, forearm, kidney and lung.  A friend of Toucheck's girlfriend was also cut during the altercation as he tried to break up the altercation that resulted in the charge of second degree battery.

     The defendant pled open ended to all charges on June 8, 2018 and a sentencing hearing was set for November 19, 2018.  Judge Suzanne deMahy sentenced Toucheck to:

• Attempted Second Degree Murder:  36 years at hard labor;
• Aggravated Battery:  5 years at hard labor;
• Second Degree Battery:  6 years at hard labor

     The sentences for Attempted Second Degree Murder and Aggravated Battery ran concurrent with each other but consecutive to the Second Degree Battery charge.

     Assistant District Attorney, Alister Charrier, handled the cases for the State of Louisiana.  "I am very pleased with Alister's efforts in these cases and Judge deMahy's sentencing." Duhe' said.  "However, most important is the participation of the brave victims in the prosecution of these cases.  Without their determination to stop being victimized, the results may not be this successful." Duhe' concluded.
